Terms of Service

Please read these terms carefully before using ReefRide.

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY.

These Terms include a binding arbitration clause and class action waiver in Section 18, which affect your legal rights. By using ReefRide, you agree to resolve disputes through individual arbitration rather than in court or through class actions.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and ReefRide LLC, a Hawaii limited liability company ("ReefRide," "we," "us," or "our"). These Terms govern your access to and use of the ReefRide website located at reefride.co (the "Site"), our mobile applications, and all related services (collectively, the "Platform").

BY ACCESSING OR USING THE PLATFORM, CREATING AN ACCOUNT, LISTING A VEHICLE, OR BOOKING A VEHICLE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY, WHICH IS INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE PLATFORM.

1. The ReefRide Platform

1.1 Platform as Marketplace

ReefRide operates an online marketplace that connects vehicle owners ("Hosts") with individuals seeking to rent vehicles ("Guests") in the State of Hawaii. ReefRide is not a car rental company. ReefRide does not own, operate, manage, or control any vehicles listed on the Platform. ReefRide acts solely as an intermediary to facilitate transactions between Hosts and Guests.

1.2 No Agency Relationship

Hosts and Guests are independent third parties, not employees, agents, joint venturers, or partners of ReefRide. ReefRide does not direct or control the conduct of Hosts or Guests and expressly disclaims any liability arising from their actions or omissions. The formation of a vehicle sharing agreement is directly between the Host and Guest; ReefRide is not a party to such agreement.

1.3 No Guarantee

ReefRide does not guarantee the quality, safety, suitability, roadworthiness, or legality of any vehicle listed on the Platform. ReefRide does not guarantee the truth, accuracy, or completeness of any listing, rating, review, or description. ReefRide does not guarantee the identity, background, or qualifications of any Host or Guest. Users rely on any information provided through the Platform at their own risk.

2. Eligibility & Accounts

2.1 Guest Eligibility

To book a vehicle through ReefRide you must:

  • Be at least 21 years of age (drivers under 25 may be subject to a young driver surcharge).
  • Hold a valid driver's license that has been active for at least one (1) year.
  • Provide a valid payment method in your name for rental charges and security deposit.
  • Complete identity verification through our platform before your first booking.
  • Meet all requirements of the applicable protection plan.

2.2 Host Eligibility

To list a vehicle on ReefRide you must:

  • Be at least 18 years of age and legally authorized to share the vehicle.
  • Hold legal title to or have written authorization from the title holder to list the vehicle.
  • Maintain the vehicle in safe, roadworthy condition with current Hawaii safety inspection and registration.
  • Maintain personal automobile insurance that meets or exceeds Hawaii minimum coverage requirements.
  • Complete identity and vehicle verification through our platform.
  • Comply with all applicable local, state, and federal laws and regulations, including tax obligations.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify ReefRide of any unauthorized access or use of your account. ReefRide will not be liable for any loss arising from your failure to protect your account information.

3. Bookings & Payments

3.1 Booking Process

All bookings are confirmed once payment is processed through our secure payment processor. By completing a booking, you enter into a vehicle sharing agreement directly with the Host. ReefRide facilitates the payment but is not a party to the rental agreement between Host and Guest.

3.2 Pricing

Hosts set their own daily rates. Prices displayed on the Platform include the Host's daily rate, delivery fees, and applicable protection plan fees. Taxes, state surcharges, service fees, and optional add-ons are itemized at checkout. ReefRide charges a service fee to both Hosts and Guests to operate and maintain the Platform.

State-mandated taxes and surcharges that may appear on your receipt include:

  • Hawaii General Excise Tax (HRS Chapter 237): 4.0% plus applicable county surcharge (effective rate up to 4.712% depending on island), assessed on the gross rental charge.
  • Rental Motor Vehicle Surcharge Tax (HRS §251-2): $7.50 per day (or $0.25 per half-hour for rentals under six hours), collected by ReefRide and remitted to the State of Hawaii.
  • Airport Customer Facility Charge (CFC): Where applicable to airport pickups, in the amount published by the Hawaii Department of Transportation.

These are state-imposed charges, not ReefRide fees. Rates may change if the underlying statutes are amended.

3.3 Security Deposit

A refundable security deposit hold may be placed on your payment method at the time of booking. The hold is released within five (5) to ten (10) business days of a successful vehicle return, provided no damage claims, policy violations, or outstanding fees exist. ReefRide reserves the right to charge the security deposit for damage, excessive cleaning, fuel replacement, traffic violations, toll charges, or other fees permitted under these Terms.

3.4 Host Payouts

Host earnings are disbursed according to ReefRide's payout schedule, less applicable service fees and any amounts owed for damage claims or chargebacks. ReefRide may withhold or offset payouts to satisfy obligations arising under these Terms.

4. Cancellations & Refunds

4.1 Guest Cancellations

  • 48+ hours before trip start — full refund of the trip price.
  • 24–48 hours before trip start — 50% refund of the trip price.
  • Less than 24 hours before trip start or no-show — no refund.

Service fees are non-refundable unless the cancellation is caused by ReefRide or the Host.

4.2 Host Cancellations

Hosts who cancel a confirmed booking may be subject to cancellation fees and penalties, including reduced visibility on the Platform and account suspension for repeated cancellations. If a Host cancels, the Guest will receive a full refund, and ReefRide will make commercially reasonable efforts to arrange an alternative vehicle.

4.3 ReefRide Cancellations

ReefRide reserves the right to cancel any booking at any time for safety concerns, suspected fraud, Terms violations, or force majeure events. Guests will receive a full refund for any booking cancelled by ReefRide.

5. Vehicle Use & Restrictions

5.1 Permitted Use

Guests agree to operate the vehicle in compliance with all applicable federal, state, and local laws, including all Hawaii traffic and motor vehicle laws. The vehicle may only be operated by the Guest listed on the booking unless additional authorized drivers have been added and approved through the Platform.

5.2 Prohibited Uses

The following uses are strictly prohibited and constitute a material breach of these Terms:

  • Operating the vehicle while under the influence of alcohol, drugs, or any impairing substance.
  • Using the vehicle for any commercial purpose, including ride-sharing, delivery services, or hire.
  • Racing, speed testing, or operating the vehicle in any reckless manner.
  • Towing or pushing any other vehicle or trailer.
  • Off-road driving unless the vehicle is explicitly designated for off-road use.
  • Transporting hazardous materials, illegal substances, or contraband.
  • Operating the vehicle outside the island where it was delivered.
  • Smoking or vaping inside the vehicle.
  • Transporting more passengers than the vehicle has seat belts.
  • Allowing any unauthorized or unlicensed person to operate the vehicle.
  • Using the vehicle for any illegal purpose.
  • Subleasing or re-renting the vehicle to any third party.

Violation of any prohibited use voids all protection plan coverage and may result in the Guest being held personally liable for any and all resulting damages, losses, costs, and expenses, including the full replacement value of the vehicle.

6. Vehicle Condition & Inspections

6.1 Pre-Trip Inspection

Guests are required to inspect the vehicle and document its condition, including any pre-existing damage, at the time of pickup using the Platform's photo inspection feature. Failure to document pre-existing damage at pickup may result in the Guest being held responsible for any damage discovered at return.

6.2 Post-Trip Inspection

Upon return, the vehicle will be inspected for damage. Any new damage not documented in the pre-trip inspection will be attributed to the Guest. ReefRide and/or the Host may file a damage claim through the Platform.

6.3 Host Obligations

Hosts are solely responsible for ensuring their vehicles are safe, mechanically sound, properly maintained, and compliant with all applicable safety and emissions standards. Hosts must accurately represent the condition of their vehicle in their listing. ReefRide does not inspect, certify, or warrant the condition of any vehicle.

7. Protection Plans & Insurance

7.1 Protection Plans

ReefRide offers protection plans that may provide coverage for physical damage to the Host's vehicle and liability protection for Guests during a booked trip. Protection plans are described on the Platform and selected at the time of booking. Protection plans are NOT insurance policies. Protection plan terms, conditions, exclusions, and limitations are set forth in the applicable plan documents.

7.2 Limitations

Protection plan coverage may be voided or reduced if the Guest breaches these Terms, engages in prohibited uses, operates the vehicle while impaired, allows unauthorized drivers, or fails to report an incident promptly. Coverage does not extend to personal belongings, loss of use, diminished value, or consequential damages.

7.3 Host Insurance

Hosts are required to maintain their own personal automobile insurance policy that meets Hawaii minimum coverage requirements. Hosts acknowledge that their personal insurance policy may not cover peer-to-peer vehicle sharing and are responsible for understanding their own coverage. ReefRide is not an insurance company and does not provide insurance advice.

7.4 No Insurance Advice

ReefRide does not act as an insurance broker, agent, or advisor. Nothing on the Platform constitutes insurance advice. Users should consult their own insurance professionals regarding their coverage needs.

8. Delivery & Returns

ReefRide or the Host may deliver vehicles to and pick them up from the Guest's specified address within the applicable service area on each island. The Guest must be present and available at the agreed delivery and return times.

  • Late returns may incur additional daily charges at the Host's daily rate plus applicable fees.
  • Returns more than 24 hours late without prior authorization from the Host or ReefRide may be treated as unauthorized use and reported to law enforcement.
  • The vehicle must be returned with the same fuel level as at pickup; a fuel replacement fee will be charged for any shortfall.
  • The vehicle must be returned in substantially the same condition as received, normal wear and tear excepted.

9. Damage, Fees & Claims

9.1 Damage Responsibility

The Guest is financially responsible for all damage to the vehicle that occurs during the booked trip period, up to the full fair market value of the vehicle, unless covered by an applicable protection plan. This includes damage from collisions, theft, vandalism, weather, negligence, misuse, and any damage resulting from prohibited uses.

9.2 Additional Fees

  • Cleaning fee: Up to $250 if the vehicle is returned excessively dirty, with smoke or vape odor, pet hair, or biohazard contamination.
  • Traffic violations & tolls: The Guest is responsible for all traffic violations, parking tickets, and toll charges incurred during the trip, plus a $25 administrative fee per incident.
  • Lost keys: The Guest is responsible for the cost of key replacement, including reprogramming, up to $500.
  • Fuel replacement: Fuel shortfall will be charged at the prevailing local rate plus a $25 refueling service fee.
  • Late return: Unauthorized late returns will be charged at 1.5x the daily rate for each day or partial day.

9.3 Claims Process

Damage claims must be submitted through the Platform within 24 hours of the trip end time. Claims submitted after this period may be denied. ReefRide will review claims, assess damage based on available evidence (photos, inspections, third-party estimates), and determine responsibility. ReefRide's determination is final and binding on both Host and Guest, subject to the dispute resolution provisions in Section 18.

9.4 Right to Charge

You authorize ReefRide to charge your payment method on file for any amounts owed under these Terms, including but not limited to damage claims, fees, fines, penalties, and chargebacks. If your payment method is declined, you remain liable for all amounts owed and ReefRide may pursue collection through other means.

10. Assumption of Risk

YOU ACKNOWLEDGE AND AGREE THAT THE USE OF VEHICLES INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO THE RISK OF BODILY INJURY, DEATH, PROPERTY DAMAGE, AND EMOTIONAL DISTRESS. THESE RISKS MAY ARISE FROM YOUR OWN ACTIONS OR INACTIONS, THE ACTIONS OR INACTIONS OF OTHERS (INCLUDING HOSTS, GUESTS, AND THIRD PARTIES), THE CONDITION OF VEHICLES, ROAD CONDITIONS, WEATHER CONDITIONS, OR OTHER CIRCUMSTANCES.

BY USING THE PLATFORM, YOU VOLUNTARILY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF REEFRIDE OR OTHERS, AND ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE PLATFORM AND ANY VEHICLE BOOKED THROUGH THE PLATFORM.

11. Release of Claims

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY RELEASE, DISCHARGE, AND HOLD HARMLESS REEFRIDE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "REEFRIDE PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, LOSSES, DAMAGES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) ARISING OUT OF OR IN CONNECTION WITH:

  • Any interaction or transaction between Hosts and Guests.
  • The condition, safety, roadworthiness, or legality of any vehicle.
  • Any accident, injury, death, or property damage arising from the use of any vehicle.
  • Any dispute between Hosts and Guests.
  • Any representations or warranties made by a Host or Guest.
  • The actions or omissions of any Host, Guest, or third party.

IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."

12. Indemnification

You agree to indemnify, defend, and hold harmless the ReefRide Parties from and against any and all claims, demands, actions, suits, proceedings, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your use of or access to the Platform.
  • Your breach of these Terms or any applicable law or regulation.
  • Your violation of the rights of any third party, including other Users.
  • Any vehicle you list on or book through the Platform.
  • Any content you post, submit, or transmit through the Platform.
  • Any accident, injury, death, or property damage arising from a vehicle you listed or booked.
  • Your tax obligations, including failure to report or pay applicable taxes.

This indemnification obligation survives the termination of these Terms and your use of the Platform.

12.1 Subrogation

To the extent ReefRide, a Host, or any insurer pays or becomes obligated to pay any amount on your behalf in connection with a vehicle, a trip, or a third-party claim, you assign to ReefRide and its insurers all rights of subrogation, contribution, and recovery against any third party, including against any other applicable insurer (auto, credit-card rental coverage, umbrella, or otherwise). You will execute any document reasonably required to perfect such assignment.

12.2 Cooperation with Claims

In the event of any incident, accident, theft, damage, injury, third-party claim, or law-enforcement contact involving a vehicle, you will: (a) report the incident to ReefRide as soon as practicable and in any event within twenty-four (24) hours (and within twelve (12) hours for theft, fire, or bodily injury); (b) obtain a police or incident report and provide a copy to ReefRide on request; (c) cooperate fully with ReefRide and its insurers, including by providing a recorded or written statement, attending interviews, producing documents, and, if necessary, appearing at hearings; (d) not admit liability, settle, release, or compromise any claim with any third party, insurer, or attorney without ReefRide's prior written consent; (e) preserve evidence, including the vehicle in its post-incident condition, until released by ReefRide or its insurer; and (f) forward promptly to ReefRide any demand, claim, suit, summons, or other legal process you receive in connection with a vehicle or trip.

12.3 Consequence of Non-Compliance

Your failure to comply with Sections 12.1 or 12.2 may, at ReefRide's discretion and to the extent permitted by law, result in forfeiture of any applicable Protection Plan coverage and shift to you direct responsibility for the underlying loss, including ReefRide's reasonable costs of investigation and recovery.

13. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

REEFRIDE DOES NOT WARRANT THAT: (A) THE PLATFORM WILL MEET YOUR REQUIREMENTS; (B) THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE PLATFORM WILL BE ACCURATE OR RELIABLE; (D) ANY VEHICLE LISTED ON THE PLATFORM WILL BE SAFE, SUITABLE, ROADWORTHY, OR AS DESCRIBED; OR (E) ANY DEFECTS IN THE PLATFORM WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

(A) IN NO EVENT SHALL THE REEFRIDE PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER REEFRIDE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(B) IN NO EVENT SHALL REEFRIDE'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF: (I) THE TOTAL AMOUNT OF SERVICE FEES PAID BY YOU TO REEFRIDE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY; OR (II) ONE HUNDRED DOLLARS ($100).

(C) THE REEFRIDE PARTIES SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY, OR LOSSES ARISING OUT OF: (I) YOUR USE OF OR RELIANCE ON THE PLATFORM OR YOUR INABILITY TO ACCESS OR USE THE PLATFORM; (II) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND ANY HOST, GUEST, OR THIRD PARTY; (III) ANY CONTENT OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM; OR (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR TRANSMISSIONS.

THE LIMITATIONS OF LIABILITY SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN REEFRIDE AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

15. Intellectual Property

15.1 ReefRide IP

The Platform, including all content, features, functionality, software, text, graphics, logos, trademarks, and service marks, is owned by ReefRide or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

15.2 User Content

By posting content (including photos, reviews, and vehicle descriptions) on the Platform, you grant ReefRide a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform. You represent that you own or have the necessary rights to grant this license.

16. Prohibited Platform Conduct

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of these Terms.
  • Post false, misleading, defamatory, or fraudulent content.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Circumvent, disable, or interfere with security features of the Platform.
  • Use any robot, spider, scraper, or automated means to access the Platform.
  • Attempt to conduct transactions outside the Platform to avoid fees.
  • Harass, threaten, or intimidate any other User.
  • Manipulate or abuse the review or rating system.
  • Collect or store personal information of other Users without consent.

17. Account Termination

ReefRide reserves the right, at its sole discretion, to suspend, deactivate, or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to: breach of these Terms, fraudulent activity, safety concerns, repeated cancellations, low ratings, or conduct that ReefRide determines is harmful to other Users or the Platform.

Upon termination, your right to use the Platform ceases immediately. Any outstanding obligations (including payment obligations, damage claims, and indemnification obligations) survive termination. ReefRide is not liable for any damages resulting from the termination of your account.

18. Dispute Resolution & Arbitration

18.1 Informal Resolution

Before initiating any formal proceeding, you agree to first contact ReefRide at legal@reefride.co and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within thirty (30) days, either party may proceed to binding arbitration as described below.

18.2 Binding Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR YOUR USE OF THE PLATFORM (COLLECTIVELY, "DISPUTES"), SHALL BE RESOLVED EXCLUSIVELY BY BINDING INDIVIDUAL ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") UNDER ITS CONSUMER ARBITRATION RULES, AND NOT IN A COURT OF LAW.

The arbitration shall be conducted by a single arbitrator and held in Honolulu, Hawaii, or, at your election, conducted remotely via telephone or videoconference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

18.3 Class Action Waiver

YOU AND REEFRIDE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING. IF THIS CLASS ACTION WAIVER IS FOUND TO BE UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.

18.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims arising in small claims court may also be brought in court rather than arbitration, provided the claim remains in small claims court.

18.5 Opt-Out

You may opt out of this arbitration provision by sending written notice to legal@reefride.co within thirty (30) days of first accepting these Terms. Your opt-out notice must include your name, address, and a clear statement that you wish to opt out of the arbitration provision. If you opt out, all other provisions of these Terms remain in full force and effect.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Hawaii, without regard to its conflict of laws principles. To the extent that any lawsuit or court proceeding is permitted hereunder, you and ReefRide agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Honolulu County, Hawaii, and waive any objection to venue or personal jurisdiction therein.

20. SMS Communications

ReefRide sends one-time transactional SMS notifications to customers who have explicitly opted in. Messages include booking confirmations, pickup and return reminders, account and security alerts, and system status notifications. We do not send marketing or promotional SMS messages.

How you consent: During checkout on ReefRide.co you will see an opt-in checkbox that is unchecked by default with the following disclosure:

"I agree to receive order, delivery, appointment, and account alerts from ReefRide.co via SMS. Message and data rates may apply. Reply STOP to opt out. This is a one-time notification service. View our Terms of Service and Privacy Policy. Consent is not a condition of purchase. Message frequency varies based on account activity."

By checking that box you agree to receive SMS messages from ReefRide at the phone number you provide. You may revoke consent at any time by replying STOP to any message. After opting out you will receive one final confirmation message and no further SMS will be sent. Reply HELP for assistance or contact us at support@reefride.co.

21. Force Majeure

ReefRide shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, hurricanes, tsunamis, volcanic eruptions, earthquakes, floods, fires, epidemics, pandemics, government orders or restrictions, war, terrorism, civil unrest, labor disputes, power failures, internet or telecommunications outages, or any other force majeure events.

22. Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the practices described in the Privacy Policy.

23. General Provisions

23.1 Entire Agreement

These Terms, together with the Privacy Policy and any applicable protection plan documents, constitute the entire agreement between you and ReefRide regarding your use of the Platform and supersede all prior agreements, representations, and understandings.

23.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

23.3 Waiver

The failure of ReefRide to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by ReefRide.

23.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without ReefRide's prior written consent. ReefRide may assign these Terms without restriction.

23.5 Notices

ReefRide may provide notices to you via email to the address associated with your account, through the Platform, or by posting on the Site. You are responsible for keeping your contact information current.

23.6 Survival

Sections 10 (Assumption of Risk), 11 (Release of Claims), 12 (Indemnification), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Intellectual Property), 18 (Dispute Resolution & Arbitration), 19 (Governing Law), and this Section 23 shall survive any termination or expiration of these Terms.

24. Changes to These Terms

ReefRide reserves the right to modify these Terms at any time. When we make material changes, we will provide notice through the Platform, by email, or by updating the "Last updated" date at the top of this page. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and close your account.
